INTRODUCTION

Please read the terms and conditions of use carefully before using the website. The Agreement sets out the legally binding terms and conditions for your use of the website(s) www.ubiquitousbutt.com (aliases: www.ubqtb.com and www.thewowcap.com) (the "Site").

By using the Site in any manner, including but not limited to visiting or browsing the Site, you (the "user" or "you") agree to be bound by this Agreement, including those additional terms and conditions and policies referred to here. This Agreement applies to all visitors to the Site.

The terms of use set out below governs the use of our online shopping website. By using this website for your purchases you accept these terms in full. Do NOT proceed otherwise.

(1) Payment:

(i). In order to use this site and make purchases you will need to supply us with contact details so that any purchases can be despatched to you. These details ( except credit/debit/charge card ) will be stored and NOT passed onto a third party.

(ii). No purchase(s) shall be despatched until the payment has been made in full.

(iii). Payments can only be made using an authorised credit/debit/charge card.

(iv). Your statutory rights apply to all transaction with ITerActive Solutions Limited ( "The Company").

(2) Products:

(i) The quality of all our products is guaranteed and is as described on the site. The shade of some colours may vary slightly, so bear this in mind when choosing a colour. Products cannot be returned simply because the colour is the wrong shade.

(ii) Should you order a product which cannot be delivered for whatever reason, e.g. out of stock, then you will be fully refunded or if you would like a different product, then email us advising this. Any credit you are due will be refunded.

(iii) A contract does not exist between us until your payment has been received in full and an invoice issued to you via email.

(3) Shipping and Posting:

(i) All of our products will be sent either via Royal Mail or Courier and will take between 7 - 14 days for delivery in the United Kingdom. For deliveries within the United Kingdom there are no extra charges. For deliveries to a European destination there is an additional charge of £7.00 (sterling). For deliveries outside of Europe there is a charge of £10 for up to £500 spent. This is to cover shipping/posting. There will be no charges for orders in excess of £500. Should you wish to expedite delivery, please advise and we will do our best to accommodate you as long as any extra cost is covered by you.

(ii) The Company shall not be held liable for any delay in delivery which is out of our control.

ABOUT UBIQUE

Ubique is the trading name of the Site, www.ubiquitousbutt.com. The raison d’etre for our Site is to promote unique items of any genre, from fashion to pottery. We are launching the site with one signature product which is the fashion house of; WOW! CTT ( Clothes That Talk).

We are constantly looking for more unique products to add to our Site, so if you think you have that unique product, then please feel free to contact us. Details to be found in the “Contact Us” section.

We are not only Unique, we are also Ubique!

RESOLUTION OF DISPUTES AND RELEASE

In the event of a complaint, in the first instance please contact us at Ubique.

Any dispute arising from or relating to the subject matter of this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales. Use of the Site is not authorised in any jurisdiction that does not give effect to all provisions of the Agreement, including without limitation, this section.

PRIVACY

Ubique, nor it’s parent company, ITerActive Solutions Limited, will not sell or disclose your personal information to third parties. The Company DOES NOT have records of your credit/debit/charge card details. Some transactions are handled by PayPal the world-renowned and reputable financial institution.

WARRANTY

All goods purchased through us are guaranteed in quality at the time of despatch. Should an item be received either damaged or below standard, they will be replaced at no extra cost, provided Ubique is informed;

1. Via email or phone within 24 hours of receipt.

2. Is returned to us (with proof) within seven days of receipt.

This Agreement shall in all respects be interpreted and governed by the laws of England and Wales.
